Buyer (User): The natural or legal person who registers on the Optiefy platform and purchases services.
This Distance Sales Agreement ("Agreement") is concluded electronically between the Seller and the Buyer within the scope of Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
2. Subject and Scope of the Agreement
The subject of this Agreement is the determination of the mutual rights and obligations of the parties regarding the Buyer's purchase of a subscription to the e-commerce storefront creation, management and AI-assisted content generation services ("Service") offered by the Seller at optiefy.com.
Optiefy is a SaaS platform offering AI-assisted storefront creation, product management, order tracking, payment integration and marketplace connectivity for social sellers and small businesses.
3. Service Plans, Pricing and Payment
Optiefy offers three subscription plans: Free, Launch and Grow. Current prices are published at optiefy.com and may be changed with prior notice.
For paid subscriptions, payment is collected by credit/debit card according to the monthly or yearly billing period chosen by the Buyer. On yearly plans, payment is taken in a single charge at the start of the period.
Prices are displayed in Turkish Lira (TL) and/or US Dollars (USD) and do not include VAT; the applicable tax is added at the invoicing stage.
4. Performance and Delivery of the Service
Optiefy is a digital service platform; no physical delivery takes place. Once payment is successfully completed, the Buyer immediately gains access to the features of the selected plan and to the dashboard.
While the Seller takes the utmost care to ensure the service operates without interruption or error, it cannot be held liable for short interruptions caused by planned maintenance, internet infrastructure failures or force majeure.
5. Right of Withdrawal
Under article 48 of Law No. 6502 and article 9 of the Distance Contracts Regulation, the Buyer may exercise the right of withdrawal within 14 (fourteen) days of purchasing the subscription, without giving any reason and without paying any penalty.
To exercise the right of withdrawal, it is sufficient to email info@optiefy.com with the subject "Withdrawal Notice". The refund is made within 14 days of receiving the withdrawal request.
However, for digital content and services prepared in line with the Buyer's wishes or personal needs, which by their nature cannot be returned or which change/deteriorate after delivery, the right of withdrawal cannot be exercised provided the Buyer has expressly consented to performance beginning.
6. Obligations of the Buyer
- Provide true and accurate information during registration.
- Keep the account secure; do not share the password with third parties.
- Use the platform only for lawful commercial activities.
- Do not upload content that infringes copyright or trademark rights.
- Comply with the Turkish Criminal Code, the Consumer Protection Law and other applicable legislation.
- Pay the subscription fee on time.
7. Intellectual Property Rights
The design, software, logo, content and all trademarks of the Optiefy platform belong to YAZILI GROUP DIŞ TİCARET LİMİTED ŞİRKETİ. The Buyer may use the services only for personal/commercial use and may not copy, distribute or sublicense the content.
The intellectual property rights in the product images, texts and brand assets the Buyer uploads to the platform belong to the Buyer. The Seller uses this content solely for the performance of the service.
8. Termination and Account Suspension
The Buyer may cancel the subscription at any time. Upon cancellation, service access continues until the end of the current billing period; no refund is made for the remaining time.
The Seller may suspend the Buyer's account or terminate the agreement without prior notice if the Buyer breaches this Agreement, the Terms of Service or applicable legislation.
9. Limitation of Liability
The Seller is not liable for content the Buyer uploads to the platform, for issues caused by third-party integrations, or for damages caused by the Buyer's own error. The Seller's total liability arising from a service defect is limited to the subscription fee collected in the last billing period.
10. Governing Law and Dispute Resolution
This Agreement is governed by Turkish law. Disputes may first be brought before the Consumer Arbitration Committees; disputes exceeding the legal threshold fall under the jurisdiction of the Istanbul Courts and Enforcement Offices.
The Buyer may also file complaints through the Consumer Information System (TBiS) operated by the Turkish Ministry of Trade. In case of any discrepancy between this English translation and the Turkish original, the Turkish version prevails.
